The project and development plan becomes part of the project-related development plan (Section 12 (3) sentence 1 of the German Federal Building Code (BauGB)).
The plan specifies the details of the project and the associated development measures, which the developer undertakes to implement in the implementation agreement.
The relevant documents (project and development plan, project-related development plan, justification of the development plan and summary statement on the manner in which the environmental concerns and the results of the public and public authority participation have been taken into account in the development plan and on the reasons for which the plan was selected after consideration of the other planning options considered) may be inspected by anyone.
Indication of the number or designation of the project-related development plan concerned.
The project-related development plan must have been published in the version which it finally received.
The inspection is free of charge (however, costs may be charged if, for example, copies of the documents are requested).
After the announcement of the project-related development plan, the citizen may contact the office stated in the announcement in order to inspect the plan and the other documents to be kept available.
The project-related development plan and the other documents to be kept available must be available at all times or must be brought to the site within a reasonable period of time. However, the inspection can generally be limited to the office hours of the authority or - if there are deviations - to the visiting hours.
The documents must be kept available at all times, i.e. throughout its period of validity, but also after it has been revoked.
The project and development plan is an integral part of the project-related development plan. It may be inspected by anyone; the same applies to its explanatory memorandum and the summary declaration.
