§ Section 61 LBO: projects not subject to procedure, removal of installations
The removal of buildings and installations must be reported to the lower building supervisory authority at least 1 month in advance.
The partial removal of a building project is considered a change to a building structure and requires a building permit.
Installations that do not require a permit may be removed without notification:

Installations in accordance with Section 61 (1) of the State Building Regulations,

free-standing buildings of building classes 1 and 3,
-
other installations that are not buildings with a height of up to 10 m.
The lower building supervisory authority must be notified of the removal of all other buildings and installations. If the building supervisory authority does not take any measures, work can begin after the expiry of the one-month period.
In the case of non-detached buildings, the stability of the building or buildings to which the building to be removed is attached must be assessed by a structural engineer within the meaning of Section 67 (2) sentences 1 or 2 LBO and verified to the required extent. If necessary, the removal must be monitored by a structural engineer within the meaning of Section 67 (2) sentences 1 or 2 LBO. This does not apply if the building is attached to a building not subject to procedural requirements.
